Comprehensive Terms and Conditions for Counseling Services
1. Scope of Application
These terms and conditions govern the legal framework for the psychological counseling contract between the counselor and the client. They apply to all counseling services agreed upon between both parties. By entering into the counseling contract, the client agrees to these terms and conditions.
2. Counseling Services
The counselor provides psychological counseling services to assist the client in coping with personal challenges, issues, or crises. The specific counseling services, goals, and scope are defined in a separate counseling contract or written agreement.
3. Confidentiality
The counselor commits to maintaining confidentiality regarding all information received during counseling. All personal data and client information will be treated confidentially and subject to applicable data protection regulations.
4. Appointments and Cancellations
Counseling appointments are scheduled through mutual agreement between the counselor and the client. The client is obligated to arrive punctually for the scheduled appointments. In case of unavailability or changes to an appointment, the client is required to inform the counselor in a timely manner.
5. Fees and Payment Terms
A fee is agreed upon for the counseling services, as defined in the written agreement or counseling contract. Payment is due upon invoice and within an agreed-upon timeframe. All payments are to be made in the agreed currency.
6. Disclaimer
The counselor assumes no liability for damages resulting from the implementation of counseling recommendations. The client is responsible for their own decisions and actions. Counseling serves as a supportive measure to assist the client in coping with their issues, but the final responsibility lies with the client themselves.
7. Duration of Contract and Termination
The duration of the counseling contract is defined in the written agreement or counseling contract. Termination of the contract is possible with adherence to an agreed-upon notice period or in cases of severe contract breaches. The specific termination provisions are outlined in the counseling contract.
8. Intellectual Property
All copyrights and intellectual property rights to counseling materials, documents, or tools provided during the counseling process remain with the counselor. The client may only use these materials for personal purposes and may not reproduce, distribute, or make them publicly accessible without the counselor's consent.
9. Severability Clause
If any provision of these terms and conditions is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected. A legally permissible provision that comes closest to the economic purpose of the invalid or unenforceable provision shall replace it.
10. Jurisdiction and Applicable Law
For disputes related to these terms and conditions and the counseling contract, the law of the country in which the counselor is based shall exclusively apply. The place of jurisdiction is the counselor's place of business.
